With Assistance of Public Lawyer, Two Persons Accused of Committing Robbery and Murder Were Acquitted

With effort of the LAS Poti Bureau lawyer, Davit Gogua, two persons accused of committing robbery and murder in groups were fully acquitted by the court.

The both defendants had been avoiding appearance at the law enforcement bodies for many years and hided. In the frames of the compulsory defense, they were appointed the attorney of Legal Aid Service.

Dato N. was accused of committing robbery together with some unidentified people in 1993 and faced from 6 to 15 years of restriction of liberty. According to the presented charge, Zviad M. together with 2 accomplices, committed robbery in 2003 and inflicted fatal injury to the victim.  Zviad M. faced from 10 to 20 years of restriction of liberty.

Both cases lacked evidences against the defendants. At the trial, the defense party paid attention of the court to the fact that the testimonies of witnesses were not consecutive and involved conflicting explanations. There was not any direct evidence proving the guilt of the persons being under defense of the public lawyer. Accordingly, the lawyer, Davit Gogua demanded acquittal for Dato N. and Zviad M.

Finally, the trial of the both case ended up with victory of the defense party and the court rendered a verdict of acquittal for Dato N. and Zviad M.
