Abkhaz Nationality Not Speaking the Georgian Language Won the Case

The citizen T.L. addressed the LAS Samegrelo-Zugdidi Legal Aid Bureau in order to receive consultation and help in drafting the lawsuit. L.M. who has infant, is registered in Gudauta district, does not speak the Georgian language and is Abkhaz nationality. In 2009, T.L. applied to the Government of Georgia for the asylum, received the Georgian citizenship and moved to live in Zugdidi. The family has very bad social-economic conditions and is registered in the unified database of the socially vulnerable families.

In September, 2016, L.B. was arrested in Zugdidi on the basis of the article 11 and the first part of article 137 of the Criminal Code of Georgia. However, he considered his detention unlawful and went on hunger strike for 16 days.

As of the Zugdidi District Court ruling dated January 30, 2017, T.L. was acquitted because there were no coordinated evidences in the case. The Bureau lawyer Mtvarisa Bigvava defended his interests.

After spending 5 months in prison under grave physical and emotional circumstance, the socially vulnerable beneficiary applied to Legal Aid Service again. This time, the public lawyer Natia Kvartskhava drafted administrative lawsuit for her where she demanded compensation in the amount of 10 thousand GEL for emotional damage, arbitrary detention, unlawful arrest.

Zugdidi District Court partially satisfied the lawsuit – Prosecutor’s Office of Georgia was obliged to pay 5000 GEL in favor of T.L.
