If there is not a dispute among the spouses, they should file their joint application to the civil registry agency.

If there is a dispute between spouses a proceeding of divorce shall be carried out in a court.

1. If the divorce was carried out by filing the joint application in the Civil Registry Agency, than the marriage shall be deemed terminated from the moment of registration of the divorce by the office. 2. If the divorce was carried out by court proceeding, court decision shall be executed upon the request of both or one of the spouses not later than within three years after enforcement of the court judgment.

If the spouses do not agree on the place of residence of children, than the court determines which parent shall be awarded the custody of which child.

1. Parents shall enjoy equal rights and bear equal obligations with respect to their children, even if they are divorced. 2. The parent with whom the child lives has no right to obstruct the other parent in having relations with the child.

1. The spouses may enter into a marital agreement that shall determine their property rights and obligations both during the marriage and in the event of divorce. 2. A marital agreement shall be made in writing and shall be notarized.

1. Property acquired by the spouses during the marriage shall constitute property owned by them in common (community property). 2. The following shall constitute the separate property of each spouse: - Property that this spouse owned before the marriage; - Things of individual use; - Property that is acquired during the marriage by inheritance or by gift; 3. By marital agreement spouses can decide the issue pertaining to property division in a different way.

Parents shall have equal rights and obligations with respect to their children. Parents are obliged to protect the rights and interests of their minor children.

1. If the parents could not reach agreement as to the amount of child support, a court solves the dispute. 2. The law does not specify the amount of child support. 3. The court shall determine the amount of child support on the grounds of a reasonable and fair assessment regarding the necessary requirement for normal maintenance and upbringing of the child and at the same time take into account the actual material status of the parents and the children.
